- “DlightWay App” – The mobile applications (DlightWay, DlightWay Driver, DlightWay Agent and DlightWay Vehicle Owner), hosted by DlightWay for providing DlightWay services to its users, including manufacturers, transporters, drivers, and all services where it acts as an Intermediary.
- “DlightWay Website” – Shall refer to www.dlightway.com, which is registered by DlightWay and used as a medium to communicate and inform users of services provided by DlightWay not limiting to its features, terms and conditions, Our contact details.
- “Account”– Shall mean the account created by the Customer on the Application for availing the Services provided by DlightWay.
- “Customer/ You”– means a person who has an Account on the DlightWay Application.
- “Carriers”– Individuals or entities that offer loading motor vehicles used to transport goods.
- “Commercial drivers”– Individuals licensed to operate loading motor vehicles to transport goods for or on behalf of carriers.
- “Shippers”– Any user of the services that is identified as the shipper, consignor, or consignee, or that owns the goods being transported.
- “Agent” – Any Authorized user of DlightWay to add loading vehicles and sub-agents.
- “Sub-Agent” – Person appointed by an Agent and authorized by DlightWay to add loading vehicles.
- “Dispatchers”– Individuals who assign loading motor vehicles and commercial drivers for conveyance of freight.
- “Applicable Laws”– Shall mean and include all applicable statutes, enactments, acts of legislature or parliament, laws, ordinances, rules, by-laws, regulations, notifications, guidelines, policies, directions, directives, and orders of any governmental authority, tribunal, or a court of India.
- “Driver”– Shall mean and include such individuals as may be evaluated, appointed and trained by an operator associated with us to provide the transportation services and persons who are registered with DlightWay and own such loading vehicles with necessary Local, National, and other applicable transport loading vehicle permits and licences to provide transportation services.
- “Force Majeure Event”– Shall mean any event arising due to any cause beyond the reasonable control of DlightWay, including but not limited to war, riots, fire, flood, acts of God, explosion, strikes, lockouts, prolonged shortage of energy supplies, pandemic, computer hacking, unauthorized access to computer data and storage devices, computer crashes, acts of state, and governmental, legal, or regulatory actions preventing or hindering DlightWay Entities from fulfilling their respective obligations under the contract, DlightWay will not be held liable for any delays or inability to fulfil commitments. During such periods, the fulfilment of our stated obligations may be deferred until the situation improves.
- “Registration Data” – Shall mean and may include the present, valid, true and accurate name, email ID, phone number and such other information as may be required by DlightWay from the Customer from time to time for registration on the Application.
- “Service(s)”– Means the facilitation of the services by DlightWay through the Application or via a telephone request, or booking on the Application and Site.
- “Substitute Vehicle”– Shall mean another loading vehicle arranged for transporting the Goods to the destination, in the event of a loading vehicle breakdown.
- “Peak charge”– Shall mean additional charge applied in the situation where the demand is more than the available supply. Peak charges may vary on the basis of various market dynamics such as cost of living, fuel pricing, vehicle maintenance costs, interest rates, demand, and supply situation etc.
- “TPSP”– Shall mean a third party service provider.
- “Vehicle”– Shall mean a loading motor vehicle as defined under The Motor Vehicles Act,1988.
2. What Information Do We Collect?
- Information You Provide to Us: When you use our services, we may ask you for certain information ("Protected Information") to facilitate your experience. This includes data such as full name, E-Mail, password, address, mobile phone number, bank name, bank account number, IFSC Code, Cancel Cheque, GST Certificate, Aadhaar Card, PAN Card, Driving Licence, Police verification, RC, PUC, Permit, Insurance Certificate, Fitness Certificate and Pin Code. We only request information necessary for lawful and service-related purposes.
- We Collect as You Use Our Services: In addition to the information you provide, we and our third-party service providers (TPSP) use technologies to automatically collect certain information as you interact with our services ("Usage Information"). This includes details like your browser, referring URL, areas visited within our services, and time of interaction. We also collect your Device Identifier, a unique number assigned to your device.
- For call centre bookings, DlightWay may record calls for quality and training purposes.
- For Loading Vehicle Bookings, we collect vehicle preferences, source and destination addresses.
- During delivery jobs, the driver's phone sends GPS coordinates to our servers. Additional information may be collected for services initiated through DlightWay including sensitive information for validation.
- In case you upload an emergency contact (name and phone number) on your account / on the Mobile Application, we will be collecting and storing such contact information to share your booking details with that contact and for use in an emergency situation.
- In case you refer a friend to our services, we will be collecting and storing such contact information (name and phone number) to get in touch with your friend, to promote our services.
- Usage Information may be collected through cookies, and you can manage cookie preferences in your browser. Third-party cookies are not covered by our Privacy Policy.
- Tracking information is collected as you navigate through our Services, including, but not limited to, geographic areas.
3. Information collected by Mobile Applications:
Our services primarily operate through mobile applications. Technical data about your device, software, and peripherals may be collected periodically for updates and support. Mobile Device Information, such as language, device details, operating system, browser type, and geolocation, may also be collected. This data helps personalize services and content within the application.
